This website (“Website”) is operated by Fit Nest. By using or accessing this Website, you agree to these terms and conditions. If you don’t agree to these terms & conditions, please don’t use or access this
Website. Fit Nest may change these terms and conditions from time to time, so you should check these terms and conditions regularly.

These Terms of Use apply to your access to and use of the Sites and do not alter in any way the terms and conditions of any other agreement you may have with Fit Nest unless otherwise directed by Fit Nest. If you breach any of these terms and conditions, your authorization to use the Sites automatically terminates and you must immediately discontinue use of the Sites.

If you do not agree to these Terms of Use and the Privacy Policy, you must immediately log off the Sites
and may not use the Sites.

COLLECTION OF VISITOR INFORMATION

Any information collected at the Sites is governed by our Privacy Policy, unless otherwise stated. To access and use certain services available through the Sites, you may be required to register with Fit Nest through a login/registration page and you must agree to be bound by any additional applicable terms and conditions contained there.

PAYMENT OBLIGATIONS

All MEMBERSHIP fees are non-refundable but transferable with an active MEMBERSHIP and amount payable as decided by the CLUB.
MEMBER agrees that his/her failure to use the CLUB facilities shall not release the MEMBER from the obligation to make all payments required by the terms of this Membership Agreement.

MEMBERSHIP AGREEMENT

MEMBER needs to share a soft copy of their government issued identity card as its necessary to verify the identity of the member for safety reasons.
MEMBER must present upon entering the CLUB his /her membership card. MEMBER agrees that they may be denied access to the CLUB without his/her membership card.
Standard Gym MEMBERSHIP includes 1 visit per day to a maximum 2 hours of workout. Additional charges to be levied if MEMBER insists for more time or visits.
MEMBERSHIP starting date decided at the time of joining or renewal cannot be altered or modified by MEMBER.
MEMBER agrees that he/she shall not engage in any type of commercial or business activity inside the facilities. MEMBER shall not act as a trainer for any other MEMBER or guests and any acts which constitute such business activities are strictly forbidden. If the MEMBER engages in such commercial or business activities MEMBER’s membership shall be subject to immediate cancellation.
MEMBER agrees to abide by all membership regulations of the CLUB and comply with the stated and customary rules for participation and use of equipment.
MEMBER agrees that MEMBER shall abide by the CLUB dress code at all times while in the facility and will not wear denims or any trousers/shorts that have denim type seams or reverts. MEMBER’s are not allowed to enter the CLUB in flipflops or bare feet.
MEMBER can hold their active MEMBERSHIP for a minimum of 10 days at a time with no maximum limits by paying additional charges and with no arrears if so any.
MEMBER agrees that he/she shall not use loud or profane language inside the CLUB premises, nor shall he/she molest, badger, assault or harass other CLUB MEMBERs, guests or employees. If the MEMBER engages in such behavior, his/her membership shall be subject to immediate cancellation.
MEMBER understands that the CLUB prohibits the use of any drugs or steroids and the MEMBER agrees not to use any drugs or steroids on the CLUB premises. The CLUB or its employees do not promote the use of any kind of drugs or steroids. MEMBER acknowledges and is aware that steroids can cause numerous physical, mental, and emotional problems relating to physical maturity and growth and may cause heart disease, strokes, liver dysfunction, sterility and infertility, and many other adverse health problems. MEMBER recognizes and acknowledges that there are serious criminal and civil penalties for the illegal possession, sale, use, trading, or exchange of drugs and steroids.
MEMBER agrees to abide by all CLUB policies, follow the directions of the employees and staff regarding safety and securities issues, and to treat the staff, employees and other MEMBERS with courtesy.
Marking attendance by suitable means is mandatory for all with active membership.
Members can upgrade their packages to the desired package by paying the difference amount, downgrading is non-refundable.
All dues to be cleared within 10 days of due dates of membership. If dues are not cleared within due date than a late fee charge of 10% of the due amount. Membership to be terminated if due date goes beyond 20 days.
Termination of membership means a member has to re-join club with a new package with all paid amount to be ceased with termination charges as levied by the management and past package discontinued.
All members must be over the age of 17 to avail services provided at Fit Nest.
Fit Nest is the sole owner of all the belongings provided in the club premises, if any MEMBER is found misusing the facilities provided, he / she will be penalized for the same or could also lead to cancellation of membership.
Damage to the properties is liable to be penalized or cancellation of membership.
Fit Nest is a private members’ club and the management reserve the right to refuse membership to any individual without cause.
CLUB won’t be liable to pay in case of any theft / loss of members’ personal belongings.
Purchase / sale of any products or in CLUB premises without any knowledge of the CLUB is strictly not allowed.
Fit Nest is not responsible for any nuisance which happens outside our premises between MEMBER but has the right to deny your membership rights because of ill behavior inside the gym premises. We strictly don’t promote any kind of affection relationships which build up between members during their term of membership.
MEMBER acknowledges that they are aware of the inherent risks of injury or ill health resulting from use of the services of the CLUB and any other Fit Nest facility under this Agreement and from participation in exercise generally. In consideration of participation in activities within the CLUB and any other Fit Nest facility, the Member agrees to that they shall participate in all activities at their own risk and responsibility whether supervised or not by staff. The MEMBER agrees to release and hold harmless the CLUB and any other Fit Nest facility from and against all actions in respect of any incident arising out of injury, loss, damage or death caused to the MEMBER in any way what so ever in their usage of the CLUB and any other Fit Nest facility.
Parking in and around the CLUB premises is at the sole responsibility of MEMBER.
MEMBERSHIP rules can be altered by the CLUB during pandemics or natural calamities which needs to be followed by all members accordingly.
The CLUB may be temporarily closed for periods of up to 2 (two) weeks each year for maintenance purposes.
Personal training services provided in this facility may be provided either by employees of the CLUB or by independent contractors operating their own business who are retained by the CLUB. Regardless, all payments for personal training services are to be made to the CLUB, who will pay the trainers as the services are provided.
Non-usage of the CLUB services does not allow a MEMBER for early termination of this agreement nor does it warrant a refund of any type. Also, it does not affect any payment terms and conditions of this agreement and that the CLUB is in no way responsible for level of usage and it's not the responsibility of the CLUB to notify of my non-usage.

PERSONAL TRAINING TERMS AND CONDITIONS

Consult your physician or other health care professional before starting Personal Training sessions to determine if it is right for your needs. Do not start a Personal Training and/or nutrition program if your physician or health care provider advises against it.
The results, if any, from Personal Training and/or nutrition programs may vary from person to person. Further, engaging in any Exercise, Fitness, Personal Training, or Nutrition program involves risks of injury. If you choose to follow any of the CLUB’s Personal Training programs or nutrition recommendations, you acknowledge this and agree not to hold the CLUB, or any other persons associated with the CLUB responsible for any injuries or damages you may incur
We believe that for most people, following our Personal Training programs and methods will lead to their desired results, all exercise programs depend on the individual. Results will be affected by the effort and commitment of the individual, however, in some circumstances even where an individual follows our program, they may not achieve the desired results. We, therefore, provide no warranties of any kind, express or implied.
Any Personal Plan will have been prepared based on information provided by you. You are responsible for the accuracy of any information that you provide to us. You are responsible for informing us of any health issues or medical conditions when asking us to prepare a Personal Plan.
The personal training sessions will expire as the number of sessions are over or the validity is over, whichever is earlier.
Personal Training is optional, and its fees are over and above the gym fees. Personal training sessions will be valid only till the gym membership is valid. Member needs to renew his/her membership to avail rest of personal training session.
The personal training form must be filled and signed by the client at the start of every session.
Member must inform 12 hours in advance if the session must be cancelled or rescheduled.
Each personal training will last for 1 hour even if the client arrives late the session will be finished at its stipulated time.
In case of the absence of your personal trainer, the client can request the manager to assign a stand-by trainer of the same level for a few sessions. These sessions will be counted as personal training sessions.
In case the personal trainer assigned to you leaves the job or is not able to attend your training The CLUB will assign you a new trainer of the same level for the remaining sessions.
There is no refund or transfer policy for personal training.
